Q: We have an agent who is listing our house and working on finding us a house. Our friends told us of a neighbor who was moving and had not yet listed their house officially. They want to do FSBO, our agent did not show us the house and they would not want to pay any fees for our agent to be involved. Are we obligated to pay him a commission since he did not show us the house? He would still get a commission for selling our house.

A: Do you have a signed buyer broker agreement with your agent that spells out the terms and fees. If the answer is no than you are free to deal directly with the homeowner. This would be a separate agreement from the one you signed when you listed your home with this agent.

A: You are not currently obligated to pay him a fee since he?s clearly not involved in the transaction. Though your Seller doesn?t care to pay a commission, he may be smart to approach the Realtor and negotiate a fee to have your Realtor write the offer and see that it gets to the closing table. That?s in your best interest as well. Having a professional at the helm is the best way to go for both Buyer and Seller. Since neither of you may buy and sell often, pitfalls may not be obvious to you. Should the Seller still decline his services, you can hire your Realtor to represent you and YOU pay his fee.. Again, it?s for your protection.

A: If they didnt show you the property, then no you have no obligation to them. There is a lot more involved with the whole process though. It could be worth while bringing them on board. I am sure the other side would be willing to compensate. You will end up getting a better deal and making sure its done correct.
